JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-09-2015 The learned counsel for the petitioner is permitted to make correction in prayer portion of the bail petition with regard to the P.S. case.

Heard both sides.

The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code and under section 27 of the Arms Act.

The informant alleged that Subodh Kumar, Vijay Saw, Fantu Saw and Suraj Kumar, the petitioner, were assaulting his wife and daughters and when the informant tried to save them the accused persons also assaulted him. Vijay Sao fired which hit on his abdomen and thigh.

No.43802 of 2015 (2) dt.21-09-2015 2/2 It is submitted that no fire arm injury was found on the person of the informant and other accused persons, namely, Subodh Kumar, Vijay Saw and Fantu Saw have already been enlarged on bail vide order passed in Cr. Misc. No. 32530 of 2015 and the case of the petitioner stands on the same footing and there is no allegation of assault against the petitioner. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hilsa, Nalanda in Telhara P.S. Case No. 64 of 2015.
