JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioner seek bail in anticipation of her arrest in connection with Bath P.S. Case No. 72 of 2018 registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.
Prosecution story is that daughter of the informant was killed by the petitioner in collusion with her husband and petitioner has illicit relationship with husband of deceased. Submission of learned counsel for the petitioner is that except suspicion there is nothing against her. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that daughter of the informant was traceless from the house of accused persons and later on her dead body was found and investigation is still going on. In view of above facts and circumstances, I am not
Patna High Court CR. MISC. No.34949 of 2019(3) dt.22-08-2019 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. She may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
