JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2019 This is an application for grant of anticipatory bail in connection with Bathnaha P. S. Case No. 70 of 2019, disclosing offences under Sections 272 & 273 of IPC and Sections 30(a) (c) of the Bihar Prohibition and Excise Act, 2016. Recovery of huge quantity of liquor stated to be recovered from the house of the petitioner. It further appears that earlier petitioner has filed an application for anticipatory bail and thereafter, withdraw the same on the ground that counsel has no instruction.
Submission of the learned counsel for the petitioner is that there is no recovery from the house of the petitioner and he has no criminal antecedent.

Having heard both sides, in view of the allegation and the huge quantity of liquor recovered from the house of the
Patna High Court CR. MISC. No.41435 of 2019(2) dt.11-07-2019 2/2 petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender before the learned court below and make prayer for regular bail.
