2. The petitioner seeks regular bail in connection with Konch P.S. Case No. 536 of 2025, registered under Sections 80, 137(2), 140(3), 3(5) of B.N.S. Act, 2023.

3. As per prosecution case, allegation is that the daughter of the informant was married in the year 2023 to Vijay Kumar @ Vimal Kumar. On 23.11.2025, he received information that his daughter has been killed by poisoning her. The petitioner is the father-in-law who is 75 years old.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. As per the counsel for the petitioner husband is already in custody since 24.11.2025. There is no specific allegation against the father-in-law. The petitioner has clean antecedent and he is in custody since 18.03.2026.

5. Learned APP for the State has vehemently opposes the prayer for bail of the petitioner.

6. Considering the age of the petitioner as well as the fact that the husband is already in custody, coupled with absence of criminal antecedent, this bail application is allowed.

7. Accordingly, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Court of A.C.J.M.- VIII, Gaya/concerned court below in connection with Konch P.S. Case No. 536 of 2025, subject to condition that before accepting bail bond, learned court below will verify the fact that the husband is in custody.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
