JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to written report of informant itself, he got information that his sister was suffering from ailment and she had been taken for treatment but when he reached at the matrimonial home of his sister, he found that his sister had already died and cremated by her in laws.

From perusal of the case diary, I find that not a single witness came forward to say that it was petitioner who killed the deceased.

Although, police after investigation has submitted charge sheet under Sections 302, 201, 120B of the Indian Penal

Patna High Court Cr.Misc. No.40091 of 2015 (4) dt.21-12-2015 2/2 Code but taking into consideration the facts and circumstances of the case as well as materials available on the case diary, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Neemchak Bathani P.S.
