2. Learned counsel for the petitioner submits that the bail application of the petitioner in connection with S.Tr. No. 13 of 2021 arising out of Gaurichak P.S. Case No. 210 of 2020 dated 17.07.2020 has earlier been rejected vide order dated 17.11.2022 passed in Cr. Misc. No. 70423 of 2021 in which liberty was granted to the petitioner that he may renew his prayer for bail, 6 months after framing of charge from the date of rejection and the Trial Court was directed to expedite the trial as earliest as possible.

3. Learned counsel for the petitioner further submits that the progress report has been called for in this case.

4. Learned A.P.P. for the State opposes the prayer

Patna High Court CR. MISC. No.36437 of 2023(3) dt.02-08-2023 2/2 for bail and submits that examination of the prosecution witnesses has been started.

5. Learned counsel for the informant vehemently opposes the prayer for bail and submits that as per his knowledge, 2 witnesses have already been examined and only 7 witnesses are left.

6. From the progress report, it transpires that the Trial Court has sought 12 months in completion of the trial in this case.

7. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present and, therefore, his bail application is hereby rejected again.

8. With this observation, the present bail application stands rejected.
