SONI SHRIVASTAVA ORAL ORDER 10-07-2025 Heard learned counsel for the petitioner, learned cousnel for the Informant and the learned APP for the State.

2. Petitioner apprehends his arrest in a case registered for the offences punishable under Section126(2), 115(2), 74, 118(1), 117(2), 303(2), 352(2), 351(2), 3(5) of the BNS.

3. The allegation in the FIR has been levelled against all the named accused persons that they came and assaulted the informant's daughter and when the son of the informant intervened in order to rescue, he was also assaulted. Further, there is a specific allegation against Shubhash Chauhan of assaulting the informant by means of knife.

4. Learned counsel for the petitioner submits that it would be apparent from the FIR itself that there is general and omnibus allegation against all the accused persons including the present petitioner. However, there is specific allegation against Shubhash Chauhan of having inflicted knife blow to the

Patna High Court CR. MISC. No.34641 of 2025(3) dt.10-07-2025 2/2 informant. It is also apparent that there is inter-se land dispute between the parties and further submission is that the petitioner is a senior citizen about 67 years of age. Learned counsel for the petitioner also invites attention of this Court to the fact that two of the other similarly situated co-accused persons have already been granted the privilege of anticipatory bail vide order dated 30.06.2025 passed in Cr. Misc. No.35250 of 2025.

5. The learned APP for the State and learned counsel for the informant oppose the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances and also considering the fact that the petitioner is a senior citizen with no specific allegation against him, let the petitioner, in the event of his arrest/ surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Roh P.S. Case No. 80 of 2025 subject to condition as laid down under Section 438(2) of the Cr.P.C.
