2. The petitioner apprehends his arrest in connection with Bhore P.S. Case No.347 of 2025, dated 14.07.2025, registered for the offence punishable under Sections 80(2), 238/3(5) of the Bharatiya Nyaya Sanhita

3. As per the prosecution case as disclosed in the FIR, the allegation against the petitioner is that he committed the murder of the informant's daughter and thereafter set her dead body on fire.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is the husband of the deceased and had neither demanded any dowry

Learned counsel submits that the deceased was suffering from abdominal pain and was taken to the hospital by the petitioner, where she died during the course of treatment. Lastly, it is submitted that the petitioner has no criminal antecedent.

Learned APP for the State has opposed the prayer for anticipatory bail and submits that the case diary was called for in this case and the materials collected during the course of investigation reveal that the deceased had hanged herself on account of cruelty, harassment and torture meted out to her for illegal demand of dowry. It is submitted that the said fact stands corroborated by the statements of the informant and other witnesses recorded during investigation, as would appear from paragraphs 3, 4, 5, 9 and 10 of the case diary, which support the prosecution case. It is further submitted that the investigation has also revealed that after committing the murder of the informant's daughter, her dead body was secretly burnt with an intention to destroy the evidence.

6. Considering the nature and gravity of the allegations, the materials collected during the course of investigation, the findings recorded in the case diary indicating that the deceased was subjected to cruelty and harassment for

No.40050 of 2026(3) dt.28-07-2026 3/3 illegal demand of dowry, and the allegation that after the commission of the offence the dead body of the deceased was secretly burnt with an intention to destroy the evidence, I am not inclined to enlarge the petitioner on anticipatory bail.

7. Accordingly, the prayer for grant of anticipatory bail on behalf of the petitioner is hereby rejected. (Ajit Kumar, J) shikha/- U T
