The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant got information from his villager that his brother Radha Nandan @ Mantu was shot dead. The informant further disclosed that half hour earlier when he was returning to his house he saw the accused persons at Chowk. There is no eye witness of the occurrence. The informant suspected that petitioner and other accused persons who had threatened his brother might have killed him.

It is submitted that similarly situated accused Santu Kumar has already been enlarged on bail vide order passed in Cr. Misc. No. 15672 of 2015 and the case of petitioner stands exactly

Patna High Court Cr.Misc. No.40857 of 2015 (2) dt.03-09-2015 2/2 on the same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Kumar Madhvendra, learned Judicial Magistrate, 1st class, Danapur in Naubatpur P.S. Case No. 314 of 2014 (G. R. No. 2197 of 2014).
