The submission of the learned counsel for the petitioners is that they are working on a Class-IV post for a very long time, some of them as long as three decades. They have not earned any promotion in all these years of service, whatever be the reasons earlier. However, by virtue of a notification, issued by the Water Resources Department, Government of Bihar, dated 16th of December, 2014 (Annexure - 2), a Rule has been put in place. Rule 5 envisages grant of promotion to the extent of 15 percent of the post and 85 percent is required to be filled up by direct recruitment.
4/4 Rule 8 lays down the procedure to be followed for grant of such promotion.
Keeping the above Rules into mind, the writ application is disposed off with a direction upon the Chief Engineer, Water Resources Department, Muzaffarpur that exercise, which has been initiated and has been going on for some time, now, will be culminate into a final decision making, by following the rules, contained in rules 5 and 8 of the 2014 Rules and ensure that all the eligible persons, who fulfill the requirements, earn their promotion, preferably within a period of four months from the date of communication / production of a copy of this order.
