The present petitioner has been filed for the following reliefs :- "That the present writ petition is being preferred for issuance of writ in the nature of mandamus commanding and directing the respondent authorities to appoint him against him in against vacant post of constable driver against Advertisement No.1/16 published by Central Selection Board, Patna and to grant all consequential benefit attach to post of constable as granted to other who are identical

Patna High Court CWJC No.3763 of 2018(3) dt.22-09-2023 2/2 and similarly situated and for other necessary relief / reliefs to the basis of fact and circumstances started hereinafter.

A counter affidavit on behalf of the respondent No.4 and 5, (Central Selection Board of Constable Recruitment) is on record and paragraph 12, the petitioner secured 30 marks whereas the cut off went to 31 in his category BC- M-NHG. Further in para 13, it has been incorporated that vide Memo No.08 Dated 22.08.2017, the recommendation has already been made to the respondents authorities enclosing the list of successful candidates for appointment as Constable Driver and thus the selection process is over.

4. In view of the said categorical statement made in paragraph 12 as also 13, no case is made out. Accordingly, the writ petition stands dismissed.
