Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bajpatti P.S. Case No. 131 of 2021 registered for offence punishable under Sections 341, 323, 324, 307, 504, 379/34 of the Indian Penal Code.
As per the allegation, on the order of the present petitioner, the other accused persons assaulted Tapeshwar Thakur.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.45361 of 2021(2) dt.13-04-2022 2/2 there is case and counter case and there is no specific allegation of assault against the petitioner. He has submitted that counter case i.e., Bajpatti P.S. Case No. 135 of 2021 has been filed by one Rajni Kumari, wife of co-accused, Sudhir Thakur. Considering the fact that the petitioner is a person of clean antecedent and there is no specific allegation of assault against him, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 131 of 2021, subject to condition as laid down under Section 438 (2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
