ANJANA MISHRA ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 22.11.2014 in connection with Deoriya P.S. Case No. 110 of 2014 for the offence registered under Sections 121 (K), 122, 123, 120(B) and 414 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act and Section 16 (KHA), 18, 19 and 20 of the UAPA Act.

Earlier the prayer for bail of this petitioner was rejected vide order dated 25.05.2015.

Learned Senior counsel appearing on behalf of the petitioner submits that petitioner was arrested on the date of occurrence itself and since then he is in custody and even on

Patna High Court Cr.Misc. No.41894 of 2015 (2) dt.09-09-2015 merits so far as the petitioner is concerned, the alleged recovery alongwith some naxal literature which is said to have been made, is not from the possession of the petitioner. Considering the period of custody and also the fact that there is no substantial recovery from the possession of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Spl Judge, Muzuffarpur in connection with Deoriya P.S. Case No. 110 of 2014.
