2. The present criminal writ has been filed for the following reliefs:
i). To direct the respondent authorities to investigate the Bhagwanpur Hat P.S. Case No. 519 of 2024 properly and arrest the accused person namely Vikash Tiwari, who has given threatening to the petitioner and his family member and pressuring them to compromise the aforesaid case.
Patna High Court CR. WJC No.1216 of 2025(2) dt.30-06-2025 2/2 II). To further direct the respondent authorities to take the accused persons on remand and record their statement, since accuse Subham Tiwari was arrested but his statement has not been recorded.
III). To direct the respondent authorities to obtain the C.D.R. of the accuse persons, which has not been taken till date.
IV). To direct the respondent authorities to provide proper sureties to the informant and his family members who had been given threatening to dire consequent on behalf of accuse persons of this case.
3. This application is disposed of with liberty to the petitioner to approach the Court of Magistrate by filing an application in light of the law laid down by the Hon'ble Supreme Court in the case of Sakiri Vasu vs. State of U.P., (2008) 2 SCC 409. If such an application is filed by the petitioner before the Magistrate, the Magistrate will pass an appropriate order in accordance with law.
