JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant.

According to prosecution case itself, for the first time, petitioner forcibly established physical relation with the informant in the year, 2010 but after the aforesaid occurrence, no case was lodged by the informant. Subsequently, the informant gave birth to a female child, upon which, her husband doubted but in the meantime, her husband was murdered and a criminal case was lodged against the petitioner but police after due investigation, found the accusation untrue and accordingly, final form was submitted in the aforesaid murder case. Furthermore, it would appear that prior to institution of this case, some other cases were

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baisi P.S. Case No. 61 of 2015 to the satisfaction of Sri Praduman Kumar, learned Judicial Magistrate-Ist Class, Purnea. (Hemant Kumar Srivastava, J) A.K.V./- U T
