ANJANA MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Itarhi P.S. Case No.07 of 2019 for allegedly having committed the offence under Section 290 of the Indian Penal Code and Sections 30(a), 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the recoveries were not from the conscious possession of the petitioner but from the poultry farm.

Having considered the facts and circumstances and that there is no criminal antecedent against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of

Case No.07 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
