JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Ishakchak P.S. Case No. 115 of 2018, disclosing offences under Sections 494, 498(A)/34 of the Indian Penal Code. Earlier on appearance of opposite party no. 2, the matter was referred to Patna High Court Mediation and Conciliation Centre and the report of learned Mediator has been received, which his kept at flag "A", from which, appears that the dispute between the parties have been resolved through the process of mediation and it appears that the petitioner agreed to keep the opposite party no. 2 and the children with himself and one of the conditions was that the petitioner will deposit Rs. 15,500/- each month in the account of the opposite party no. 2 and the opposite party no. 2 and her children
Patna High Court CR. MISC. No.34556 of 2019(3) dt.21-08-2019 2/2 should also be given the benefit of Medical Reimbursement Scheme 2003 of BSNL, in which, the petitioner is an employee. Learned counsel for the petitioner and opposite party no. 2 admitted the aforesaid fact.

Having heard both sides, in view of the abvoe facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Ishakchak P.S. Case No. 115 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
It is also made clear that the petitioner will abide by the terms of agreement, failing which, opposite party no. 2 would be at liberty to move for cancellation of bail bond of the petitioner. Let a copy of the mediator's report as well as the terms of agreement be communicated to the concerned court below forthwith.
