Petitioner is an accused in a case registered for the offence under sections 302/34 of the Indian Penal Code. It is alleged that out of previous enmity, the petitioner and other accused persons came to the house of the informant and strangulated to death her two years' old son Aman Kumar. Learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus and not specific. Besides this, the post mortem report does not sepak about any sign of external injury on the person of the deceased. Except one case mentioned in paragraph 3 of the bail application, petitioner is not accused in any other case. He is in custody since 3.4.2019.

Considering the facts of the case, let the petitioner,

Patna High Court CR. MISC. No.36545 of 2019(3) dt.04-09-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Warisnagar Police Station Case No. 209 of 2017, subject to the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
