The present application has been filed for modification of the order dated 07.07.2023 passed in Cr.Misc. No.24378 of 2023 to the extent of modifying the condition added at the last para of the order and also order dated 06.10.2023 passed in Cr. Misc. No.63096 of 2023 to extend the period to surrender. 3.

Learned counsel for the petitioner submits that in the aforesaid order, in the last para, learned court below was directed to accept the bail bond of the petitioner after verifying the fact that the petitioner has resigned from the service. In this regard, it was found that the petitioner was terminated from the service by letter dated 23.01.2023 but her bail bond was not accepted as she has not resigned but was terminated. As such,

Considering the submission of learned counsel for the petitioner, the order dated 07.07.2023 passed in Cr.Misc. No.24378 of 2023, is modified to the effect that the last para be read as "the bail bond of the petitioner shall be accepted by the court below after verifying that she was terminated/or has resigned from the service."

Further, the period of surrender is extended by six weeks from the date of receipt/production of a copy of this order in connection with Paharpur P.S. Case No.367 of 2022, pending in the court of learned A.C.J.M. X, East Champaran at Motihari, subject to deposit of Rs.2000/- (Rupees Two Thousand) in the Victim Compensation Fund.

The order dated 07.07.2023 passed in Cr.Misc. No.24378 of 2023 & dated 06.10.2023 passed in Cr. Misc. No.63096 of 2023 are modified to the extent as indicated above. 7.

Accordingly, this modification application stands disposed of.
