1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Kursakanta P.S. Case no.202 of 2020 registered under sections 366A, 363, 365 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have kidnapped the minor sister of the informant.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegations levelled are false and concocted. Referring to the statement of the sister of the informant recorded under section 183 B.N.S.S. (Annexure-P/2), it is submitted that she clearly describes her age to be 18 years and has categorically stated

Learned counsel submits that the petitioner and the sister of the informant have a child out of the said wedlock and the instant application for bail has also been sworn by the sister of the informant i.e. wife of the petitioner. The petitioner is in custody since 9.3.2025, has no criminal antecedent and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations, the submissions made by learned counsel for the petitioner and specially the contents of the statement of the sister of the informant recorded under section 183 B.N.S.S. together with the petitioner having remained in custody since 9.3.2025 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Kursakanta P.S. Case no.202 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Araria.
