The petitioner is in custody in connection with Kotwali (Tikamanjhi) P.S. Case No. 216 of 2019 for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)A, 26(ii) and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 20.03.2019. He further submits that in the instant case nine persons were named accused. It is alleged that they were staying at Shish Mahal Hotel in order to commit crime. From the room of the hotel one country made pistol with live cartridges were recovered from the possession of the petitioner.
