JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT Date: 28-08-2018 Prayer in the present writ application is to issue the direction to the respondent authorities to provide protection to her, property of the petitioner, to her husband and in-laws as according to the petitioner the private respondent has been giving threats of serious consequences and even to do away with their lives. The petitioner claims that she has solemnized her marriage with one Jwala Rai against the wish of her parents and near relation. For that reason, the father of the petitioner has lodged a criminal case giving rise to Tajpur P.S. Case No.202 of 2016. She has claimed herself is about 18 years.
2. Learned counsel for the State has pointed out from
Patna High Court Cr. WJC No.1190 of 2016 dt.28-08-2018 2/2 the counter affidavit that police has conducted investigation and found that there is no threat to her, her husband and in-laws.
3. Taking note of the stand of the State, even though this Court is not issuing any direction at this stage, it is made clear that it will be an obligation on the part of the officer-in-charge of the concerned police station where the petitioner is residing to ensure the safety and security of the petitioner from the hand of her parents, if there is any threat to her life. This being a law and order issue the concerned police station will take care of it as and when any complaint in this regard is brought to its' notice.
4. This writ application stands disposed of with the aforesaid observations and directions.
