03-06-2019 Heard Sri Manoj Kumar Jha, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 20-02-2019, as stated in paragraph - 14 of the petition, in Shahkund (Sajour) P.S. Case No. 42 of 2019 registered for offence under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act, 1959, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in a case, as if, petitioner was one of the member, who was allegedly assembled, for committing dacoity. He submits that from

Patna High Court CR. MISC. No.35539 of 2019(2) dt.03-06-2019 2/2 possession of the petitioner, nothing has been recovered. Considering the nature of accusation and period of custody, let the petitioner namely Kanhaiya Paswan @ Manohar Kumar be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhagalpur in connection with Shahkund (Sajour) P.S. Case No. 42 of 2019, corresponding to G.R. No. 691 of 2019.
