JUSTICE SHIVAJI PANDEY ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner is seeking regular bail in connection with Bochahan P.S. Case No. 298 of 2014, registered for the offence punishable under Sections 302, 376, 201/34 of the Indian Penal Code and under Section 4/6 of the POCSO Act.
This Court has received D.N.A. report from the Director, Forensic Science Laboratory, Patna, in a sealed cover.
In presence of learned counsel for the petitioner the sealed cover D.N.A. report is opened and placed for perusal of this Court.
Patna High Court Cr.Misc. No.42244 of 2015 (14) dt.10-05-2017 2/2 Upon perusal of the D.N.A. report, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of six months from the date of receipt / production of a copy of this order and report this Court.
Let the D.N.A. report be transmitted to the Court of the 1st Additional Sessions Judge-cum- Special Judge, POCSO Act, Muzaffarpur.
