2. This application for anticipatory bail arises out of Biraul P.S. Case No. 390 of 2025, registered for the offence punishable under Sections 329(3), 126(2), 115(2), 118(1), 303(2), 76 and 3(5) B.N.S.
3. As per the allegation, the petitioners along with other accused persons, armed variously with lethal weapons, allegedly objected the unloading of the building materials of the informant and, on protest, they started assaulting the informant, as a result of which informant sustained injuries on his head,

No.35585 of 2026(2) dt.21-05-2026 2/3 when the wife and son of the informant came to his rescue, petitioner No.1 also assaulted the son and wife of the informant by means of iron rod, resulting into injury on their heads and hand. It is also alleged that petitioner no.2 snatched gold chain from the neck of the informant's wife.
4. Learned counsel for the petitioners has submitted, referring to Annexure-P/2 series, that the injuries sustained by the informant, his wife and his son are simple in nature. It has further been submitted that a partition suit is pending between the parties and there is land dispute between them. It has further been submitted that the informant side were the aggressors and the case is false. It has further been submitted that no such occurrence ever took place and there is general and omnibus allegation against the petitioners. It has further been submitted that petitioner No.1 has filed a complaint case against the prosecution party. It has lastly been submitted that the petitioners have got no criminal antecedent.
5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioners.

7. Considering the facts and circumstances, let the petitioners above named, in the event of their arrest/surrender
Patna High Court CR. MISC. No.35585 of 2026(2) dt.21-05-2026 3/3 within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Biraul, Darbhanga, in connection with Biraul P.S. Case No. 390 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
