The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 420 and 120B of the Indian Penal Code and under Sections 27(b)(ii), 27 'D' of the Drugs and Cosmetic Act.

The petitioner was arrested from the medicine shop and it was found that the petitioner was selling medicines without prescriptions of the doctor. Codine Phophate medicines, Bacalm 5, Alprazolam and other medicines were recovered and the petitioner did not show the license of the shop.

It is submitted that the petitioner happens to be brother of Md. Saud who is the licensee of the shop. The petitioner is a teacher and he was simply sitting on the shop for the help of his

Patna High Court Cr.Misc. No.41652 of 2015 (2) dt.15-09-2015 2/2 brother. The petitioner is in jail since 10.07.2015. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Araria P.S. Case No. 334 of 2015.
