The petitioner seeks bail in a case registered for the offences punishable under Sections 409/406/420/ of the Indian Penal Code.

In pursuance of an agreement, petitioner has lifted paddy from Bihar State Food and Civil Supplies Corporation for delivering rice but he failed to deliver the rice. The petitioner did not supply 3805.00 Quintals of rice and thus misappropriated a sum of Rs. 82,39,956/-. A certificate case is also going on for realization of the amount. Petitioner is in jail fro more than two months.

Learned counsel for the Bihar State Food and Civil

Patna High Court Cr.Misc. No.41869 of 2015 (2) dt.11-09-2015 P2/2 Supplies Corporation has submitted that, of course, there is misappropriation of huge amount for which certificate case is also going on for realization of the aforesaid amount. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with OBRA P.S. Case No. 40/15.
