JUSTICE RAKESH KUMAR ORAL ORDER 03-04-2017 The present modification petition has been filed with a prayer to modify an order, which was passed on 30.10.2015 by a Bench of this Court in Civil Review no.459/2011. Sri S.D.Yadav, learned Addl. Advocate General no.9 submits that before the order dated 30.10.2015, in Birpur P.S. Case No.88/2008 chargesheet was already submitted by the Vigilance Investigation Bureau on 30th April, 2015. Meaning thereby that on the date of order, the petitioner/State was well
Patna High Court MJC No.3633 of 2016 (3) dt.03-04-2017 2/2 aware regarding filing of final report. Though the order in Civil Review was passed on 30.10.2015, the present petition was filed about one year thereafter i.e. 05.10.2016.
Considering the fact that chargesheet was already submitted, the direction for submitting chargesheet in Civil Review had no application. In view of change circumstances, the Court considers that there is no need to pass any further order. The petition stands disposed of.
