JUSTICE MUNGESHWAR SAHOO ORAL ORDER 19-12-2016 After some argument, the learned counsel for the petitioner seeks permission to withdraw this Civil Miscellaneous application with liberty to press Misc. Case No.9 of 2016 before the District Judge, Gaya.

If it is pressed by this petitioner, the District Judge shall pass order according to law after hearing the petitioner. Since this miscellaneous application has been filed making a grievance that the court where Order IX Rule 13 C.P.C. has been filed is on long leave, it is expected that considering the urgency in the matter, the District Judge shall redress the grievance of the petitioner according to law.

In view of the submission of the learned counsel for the petitioner, I permit him to withdraw this Civil Miscellaneous application with liberty as aforesaid. Accordingly, this Civil Miscellaneous application is dismissed as withdrawn. Saurabh/- (Mungeshwar Sahoo, J) U T
