The petitioner is in judicial custody in connection with Town P.S. Case No. 332 of 2022 for the offences under Sections 323, 353, 307 of the Indian Penal Code and under Section 37 of the Bihar Prohibition and Excise Act, 2018. The petitioner who has three criminal antecedents under his belt, has been alleged to be fighting with another person on the street in an inebriated condition and when the police tied to intercept, it is alleged that he also used sword against them. Accordingly, he was taken into custody and

Patna High Court CR. MISC. No.36647 of 2022(2) dt.22-09-2022 2/2 subjected to breath analyzer which was found to be positive. Considering the attitude of the petitioner, his act as also the fact that he has criminal antecedent, for the present, this Court is not inclined to grant him the privilege of bail which is accordingly rejected.
