The petitioner is languishing in custody for the offences punishable under Sections 467/468/420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is alleged from a pickup. However, three persons on a two wheeler were arrested on suspicion that they were scorting the said liquor on the pickup van. The petitioner was one of them.

Submission is that false allegation is there on suspicion. Investigation against the petitioner is already complete.

No.36716 of 2019(2) dt.18-06-2019 2/2 Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with G.O. Case No.358 of 2019, arising out of Baheri P.S. Case No.60 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
