The petitioner seeks bail in connection with Rampur P. S. Case No.120 of 2021, instituted for the offences under Section 37(2) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 09.04.2021 and charge-sheet has been submitted in this case.

Allegation in the F.I.R. is that the informant alleges that this petitioner was apprehended and on examination by breath-analyzer, it was found that he had consumed about 212mg./100 ml. Alcohol.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated as he was not ready to

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 09.04.2021 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise Act, Gaya in connection with Rampur P. S. Case No.120 of 2021.

The application stands allowed.
