The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Didarganj P.S. Case no. 277 of 2021 instituted for the offence punishable under Sections 25(1-b)/A/26 of the Arms Act.
Prosecution case relates to recovery of one country made pistol from a plastic bag which has been kept in the tea shop which belongs to the petitioner.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has been falsely implicated in this case. Petitioner has no concern with the alleged recovery of country made pistol. Neither the petitioner
Patna High Court CR. MISC. No.36050 of 2022(2) dt.07-12-2022 2/2 was arrested on spot nor any incriminating article has been recovered from his conscious and constructive possession. Learned APP appearing for the State has opposed the prayer of bail and submitted that the petitioner has got two criminal antecedents and the alleged tea shop belongs to the petitioner from where the country made pistol has been recovered.
Having heard learned counsel for the parties and taking into consideration that the alleged tea shop belongs to the petitioner, from where recovery of illegal country made pistol has been made, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
