The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The petitioner is not named in the FIR. Six persons are named in the FIR and specific allegations are made against them. Name of the petitioner has come during the course of investigation as one of the conspirators since he was found loitering in and around the place of occurrence. No specific allegation has been made against the petitioner. Similarly situated co-accused Manoj Kumar and Mukesh Kumar have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.42272 of 2015 (2) dt.16-09-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Khagaria in S.C. No. 170 of 2015, arising out of Allouli P.S. Case No. 103 of 2015.
