The petitioner seeks bail in connection with Turkauliya P.S. Case No.114 of 2019 registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. Though the allegation against the petitioner that he assaulted with iron rod on the head of Shiv Nath Ram upon the order of Shankar Ram, the injury report annexed as annexure-2 to this application shows that the doctor has opined the injury to be grievous.
Considering that save and except Section 307 and 379 of the Indian Penal Code all other sections are bailable in nature, the petitioner, who is in custody since 22.02.2019 and
Patna High Court CR. MISC. No.33903 of 2019(2) dt.23-05-2019 2/2 has made statement in paragraph-3 of the application that he has got no criminal antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. Case No.114 of 2019 subject to the following conditions:- (a) that the petitioner shall attend court in accordance with the conditions of the bond executed, (b) that the petitioner shall not commit an offence similar to the offence of the present case, and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
