Petitioner seeks regular bail in a case registered for the offence punishable under Section 387/302/34 of the Indian Penal Code and u/s 25(1-b)A, 26, 27, 35 of Arms Act. As per the prosecution case, two miscreants riding on motor cycle came to the shop and demanded Rangdari and on refusal they fired upon the brother of the informant and fled away. During treatment brother of informant died. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation and only material that has come against this petitioner is that he is uncle
Patna High Court CR. MISC. No.45054 of 2021(2) dt.04-01-2022 2/2 of co-accused, Vivek Kumar, and he helped co-accused, Vivek Kumar, in commission of offence. Petitioner is in custody since 02.03.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi PS case No.153/2021.
