JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Murliganj P.S. Case No. 18 of 2022, registered for the offence punishable under Section 380 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 01.07.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation and also period of custody, this application is allowed.
