JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he committed murder of his three years old daughter by throwing her on the ground and when the informant being mother tried to rescue her daughter, she was assaulted and, thereafter, she was confined in a room from where she was recovered by the police, who reached there after getting information. The post mortem report of the deceased corroborated that deceased died due to injuries sustained on her head.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of bail to the petitioner and accordingly, his prayer for
Patna High Court Cr.Misc. No.44458 of 2015 (3) dt.12-01-2016 2/2 bail in connection with Basantpur P.S.Case No. 145 of 2014, pending in the court of Chief Judicial Magistrate, Siwan stands rejected.
However, if the case of the petitioner has not been committed to the court of sessions, the concerned court should commit the case of the petitioner to the court of sessions in accordance with law as early as possible and after that the concerned sessions court should expedite the trial of the petitioner.
