The petitioners apprehend their arrest in connection with Telhara P.S. Case No.55 of 2021 registered for the offences under Sections 147, 148, 149, 109, 114, 115, 341, 323, 504, 506, 307, 332, 333, 353, 143, 145, 151, 152, 336, 337, 338, 356, 379, 427, 436 and 120(B) of the Indian Penal Code and Sections 3/4 of the Public Property Damage Act.
Considering the fact that petitioner no.2, namely, Rohit Kumar has criminal antecedents, I am not inclined to anticipatory bail to him. His application for anticipatory bail is dismissed.
So far as petitioner no.1, namely, Satyendra Kumar @
Patna High Court CR. MISC. No.45743 of 2021(2) dt.12-04-2022 2/2 Satyendra Jamadar is concerned, he is a member of the mob of 500 persons who assembled to protest the death of six persons caused due to rash and negligent driving of the driver of a truck. Considering the nature of allegation, the application on behalf of the petitioner no.1, namely, Satyendra Kumar @ Satyendra Jamadar is allowed.
Accordingly, let petitioner no.1, namely, Satyendra Kumar @ Satyendra Jamadar, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Hilsa (Naland) in connection with Telhara P.S. Case No.55 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
