ANJANA MISHRA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner apprehends his arrest in connection with K.Hat (Madhubani) P.S. Case No. 965 of 2014 for the offences registered under Sections 341, 307, 354, 380, 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that so far as the allegation against the petitioner is concerned, he had introduced the vendee/informant to the land owner, accused no. 3 in the present case, who was associated with accused no. 1. The allegation is that the said Anil Kumar Mishra had taken the complainant to the petitioner and the petitioner being

known to the vendee namely, Bibi Ayesha Khatoon had got a sale deed executed, for which, certain money exchanged hands but the informant was not put into possession and she was assaulted and a gold chain worth Rs. 16,000/- was snatched from her possession. It is further submitted that admittedly, the sale deed had been executed and so far as the petitioner is concerned, the only role which is assigned to him, is of introducing the vendor to the vendee. It is further submitted that co-accused Anil Kumar Mishra has been extended the privilege of anticipatory bail vide order dated 02.09.2016 passed in Cr. Misc. No. 34461 of 2016.

Considering the aforementioned facts and circumstances of the case and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnia in connection with K. Hat (Madhubani) P.S. Case No. 965

of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
