The petitioner seeks bail in Karakat P.S. Case No. 184 of 2020, registered for the offence punishable under Sections 324, 307, 302/34 of the Indian Penal Code.

As per the FIR, 05 unknown persons riding on 03 motorcycles intercepted the informant and his father and are alleged to have attacked them with knife, as a result of which both of them sustained injuries and during treatment father of informant died.

It is submitted on behalf of the petitioner that name of petitioner transpired during of course of investigation on the basis of confessional statement of co-accused Atal Bihari. Two

No.45234 of 2021(3) dt.04-01-2022 2/2 eye-witnesses of the occurrence have stated that one Apache and one Platina motorcycle was used in the alleged occurrence whereas, the motorcycle which is said to have been recovered from house of this petitioner does not match with the description of motorcycle given by the two eye witnesses used in the alleged occurrence. Petitioner is in custody since 12.12.2020. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Bikramganj, Rohtas at Sasaram in connection with Karakat P.S.
