The petitioners are apprehending their arrest in connection with Mahua P.S.Case No.216 of 2019 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is about recovery of more than 4000 ltrs. of liquor from the Truck.. Petitioners were named on the basis of the confessional statement of the coaccused. Submission of the learned counsel for the petitioners is that except the confessional statement there is nothing against him and after investigation in this case they have been made

Patna High Court CR. MISC. No.34087 of 2019(3) dt.05-09-2019 2/2 accused in one more case in which they have been granted bail. Heard learned A.P.P. , who has opposed the prayer for bail stating that the petitioners are accused in one more case but they have not stated so in the petition , as such there is suppression of fact in the present case.

Heard learned counsel for the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
