The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Nasriganj P.S. Case no. 11 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 379, 337, 338, 153A, 225A, 504 and 506 of the Indian Penal Code.
As per allegation in the FIR, on occasion of Makarsakranti, Hariganj Mela was organized. Some antisocial elements including the petitioner were misbehaving with the females. On objection made by the informant, petitioner along with other co-accused persons started to abuse and assault the informant and others.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. General and omnibus allegations have been levelled against the petitioners. Both parties have sustained injuries in the
Patna High Court CR. MISC. No.45722 of 2021(2) dt.23-03-2022 2/2 alleged occurrence. There is case and counter case. After prevailing good sense, the matter has been compromised between the parties and a compromise petition is annexed as Annexure-2 series to the petition. Similarly situated accused persons have been granted bail by this Court vide order dated 24.1.2022 passed in Cr. Misc. No. 7257 of 2021.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Nasriganj P.S. Case no. 11 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III at Bikramganj, Rohtas subject to the conditions as laid down under section 438(2) of the Cr.P.C.
