The petitioner is languishing in custody since 11.02.2013 in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the sister of the informant after about three years of the marriage for nonfulfillment of the dowry demand. The dead body was recovered subsequently with head injuries.

It is submitted by learned counsel for the petitioner that the identification of the dead body has not been made since it was highly decomposed and informant has retracted

Patna High Court Cr.Misc. No.40852 of 2013 (11) dt.16-02-2015 2/2 from the initial version and filed petition to that effect before the learned court below.

Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. It is expected from learned Additional Sessions Judge 5th, East Champaran at Motihari to conclude Sessions Trial No. 490 of 2013 arising out of Paharpur P.S.
