The petitioners seek bail in Pakaribarawan P.S. Case no. 64/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
Petitioner no. 1 Pappu Yadav is alleged to have assaulted Karu Yadav, the informant and there is no allegation of assault against Arjun Yadav (Petitioner no. 2). The informant, his wife and his son are alleged to have been assaulted. The assailant of the wife of the petitioner is Umesh Yadav, brother of the informant. The informant got simple injury on his head, as appears from perusal of the order of learned Sessions Judge. Learned counsel for the informant as well as learned
Patna High Court Cr.Misc. No.41103 of 2015 (2) dt.09-09-2015 2/2 Additional P.P., however, with full force on their command opposed the prayer of bail.
Considering the facts aforesaid and the fact that Petitioner no. 1 is alleged to have assaulted the informant and informant got simple injury and there is no allegation of assault against Petitioner no. 2 Arjun Yadav, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah, in connection with Pakaribarawan P.S. Case No. 64/2015.
