Petitioner seeks bail in Khagaria (Chitraguptanagar) P.S. Case No.333 of 2020 registered under Sections 380, 461 and 411 of the IPC.

The informant alleged that after having received the information of breaking the ATM, he informed the police and the owner of the house and proceeded towards the place of occurrence. One Mantosh Kumar was apprehended and from his possession, some equipments for breaking the ATM were recovered. Mantosh Kumar disclosed the name of the petitioner as his associate. The petitioner is in custody since 17.05.2020. The petitioner has already remained in jail for more than seven months and he has got no criminal antecedent.

No.34317 of 2020(2) dt.05-01-2021 2/2 Taking into consideration the facts that the name of the petitioner surfaced in the case in the confessional statement of co-accused and no incriminating article was recovered from possession of the petitioner and the petitioner has remained in jail for more than seven months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria (Chitraguptanagar) P.S.
