The petitioner seeks bail in Muzaffarpur R.P.F. Case No. 09 of 2014 registered under section 3 of the Railway Property (Unlawful Possession) Act, 1966.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 02.12.2014 with the following observation :- "Since the petitioner is in custody, learned RailwayJudicial Magistrate, Sonepur, Saran is directed to hold the trial on day-to-day basis and conclude the same as early as possible, preferably within seven months from the date of receipt/production of the copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail."

The further submission is that the petitioner has got no criminal antecedent and he is in custody since 3rd July, 2014. Regard being had to the facts and circumstances of the case, the petitioner Mithun Kumar @ Mintun Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Sonepur, Saran in connection with Muzaffarpur RPF Case No. 09 of 2014.
