This application, for grant of anticipatory bail, arises out of Maheshkhunt P.S. Case No. 31/2017, disclosing offences under Sections 419 and 420 of the Indian Penal Code. Allegation as per F.I.R. is that in course of checking one person was appearing in the examination of Bihar School Examination Board, in place of the petitioner and he disclosed his name as Abhimanyu Kumar.

Submission of learned counsel for the petitioner is that the petitioner is that earlier there was scuffle between the petitioner and the co-accused Abhimanyu Kumar and petitioner was at inimical terms with the said Abhimanyu Kumar, who is

Patna High Court CR. MISC. No.34097 of 2019(2) dt.20-08-2019 2/2 the son of informant and by manipulation in the admit card of the petitioner, he sat in the examination. Further submission is that petitioner is ready to abide by any condition imposed on him.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Khagaria, in connection with Maheshkhunt P.S. Case No. 31/2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and with further subject to the condition that petitioner will cooperate with investigating officer and appear as and when required by him, failing which, the prosecution will be at liberty to move for cancellation of his bail bonds.
