2. The petitioner seeks regular bail in connection with Jamui P.S. Case No. 856 of 2024 registered for the offence under Sections 137(2) and 96 of the Bharatiya Nyaya Sanhita, 2023.
3. The petitioner is accused of kidnapping the victim girl. The petitioner and the victim are relatives.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 04.02.2025.
5. Learned A.P.P. for the Stae has vehemently opposed the prayer for bail.
6. Though the allegation against the petitioner is of
Patna High Court CR. MISC. No.34683 of 2025(4) dt.11-09-2025 2/2 kidnapping the victim girl but from the statement of the victim girl recorded under Section 183 BNSS, it appears that the victim girl had eloped with the petitioner on her own.
7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui/concerned Court below in connection with Jamui P.S. Case No. 856 of 2024.
