The petitioner is in custody in a case registered under Sections 25(1-B)a/25(1-A)/25(1-AA)/25(1-C)/26(i)(ii)/35 of Arms Act.
The allegation against the petitioner is that six semi manufactured pistols set and 12 semi manufactured maganize have been recovered from the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.6.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. It is further submitted that 12 semi manufactured magazines are said to have been recovered
Patna High Court Cr.Misc. No.41387 of 2015 (3) dt.30-10-2015 2/2 along with six semi manufactured pistols from the possession of the petitioner. No compliance of Section 100 Cr.P.C. has been followed. The recovered articles are not effective for use. It is further submitted that the petitioner may be released after completion of seven months in custody from 12.6.2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released, after completion of seven months in custody from 12.6.2015, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Munger in Muffasil P.S.Case No. 110 of 2015.
